Mandatory Patenting in Israel
In some situations, it is mandatory to file the first application in Israel.
According to the Patents Law 5727—1967, an Israel national, a permanent resident of Israel or any other person who owes
allegiance to the State must file the first application in Israel, in the following cases:
Inventions which appear to be relevant to National security or which include a defense secret.
Inventions the subject of which is weaponry or ammunition, or which are otherwise of military value.
Inventions which may be important for the development of the use of nuclear energy in Israel, or that the
publication of the invention is liable to cause damage to nuclear research in Israel.
In these cases, you must file the first application in Israel; after 6 months, if there are no objections from the Government, you can file abroad.
Furthermore, the obligation to first file in Israel, for any subject matter (together with further duties) also applies to a State employee, soldier, policeman or employee of a State enterprise or institution designated by the Minister of Justice.
