Consulting on Patents and other IP
People often ask, how to start, what to do first, technical development or patent protection or commercialization?
The answer is clear: First a patent application must be submitted in order to protect the invention and to improve your chances in getting a registered patent.
If someone else gets a patent for your invention - the product you have developed will do you no good.
Another consideration: the development of a product is more expensive and takes longer, from drafting and filing a patent application.
But there is an exception: if there are doubts regarding technical feasibility, a proof of concept investigation may be required. In any case, we can help you with both
the legal/patenting and the technical/engineering aspects of protecting your invention.
The patent laws worldwide demand a proper technical disclosure as a mandatory prerequisite to patent grant. In the United States the Patent Laws go one step
further and require a disclosure of the BEST EMBODIMENT OF THE INVENTION.
Failure to comply with these requirements may prevent a patent grant, or the cancellation of a registered patent.
We can assist you in devising a strategy, taking into consideration your invention characteristics as well as your business goals.
Important Issues to Consider
A first prerequisite to patenting is a sound technical description, as detailed in "Patenting Strategy".
If the examiner is not persuaded, the examination may take a very long time.
Clarity: Often people are concerned that the patent will be too specific, therefore too narrow and will provide insufficient protection.
They insist on keeping the description vague, to achieve a wider patent protection.
Indeed, a broad patent protection is a worthy goal, but a vague disclosure will not achieve that goal.
You can't eat the cake and leave it whole, to withhold your invention and to get a patent granted. There are other, legitimate means for achieving a broad patent protection, if possible.
