Revival of Abandoned Patent Applications
According to Section 21A of the PATENTS LAW 5727-1967, an abandoned patent application may be revived within 12 months from the refusal.
After 12 months, it is much more difficult or impossible to revive the application.
If the applicant desires to revive the application, they may consider reviewing and even improving the patent application. This may be a good opportunity to enhance and strengthen the application, thus to improve the chances of successfully passing the examination and achieving a quality patent.
The PATENTS LAW allows to introduce new matter prior to allowance, although such matter may be assigned a later date.
However, additions based on the original application may be accepted with the original filing date.
